Workplace investigations often take center stage long after the investigation is over. This panel brings together an investigator, a plaintiff’s attorney, and a defense attorney to examine how investigations are used—and challenged—when disputes reach the courtroom. Panelists will discuss how investigation reports and findings are treated as evidence at trial, common evidentiary and privilege issues, and strategies for examining or defending investigators as witnesses. Attendees will gain practical insight into how to conduct investigations with potential litigation in mind and how to effectively use—or attack—an investigation once it becomes part of the record.
